Terms of Use (EULA) for PulsePacer

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "your") and PulsePacer ("we," "us," or "our") governing your use of the PulsePacer application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. Description of the App

PulsePacer is an iOS running app that provides real-time audio feedback based on your heart rate zones. The App connects to compatible Bluetooth heart rate monitors to deliver zone-based training cues during workouts.

3. Subscriptions

a. Subscription Plans

PulsePacer offers auto-renewable subscription plans that unlock premium features. Details of available plans, including title, duration, and pricing, are displayed within the App at the point of purchase.

b. Billing and Renewal

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.

c. Managing and Cancelling Subscriptions

You can manage or cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period. No refunds are provided for any unused portion of a subscription period.

4. User Responsibilities

  • You must be at least 16 years old to use the App.
  • You are responsible for maintaining the security of your device and account.
  • You agree not to reverse engineer, decompile, or disassemble the App.
  • You agree not to use the App for any unlawful purpose.

5. Health Disclaimer

PulsePacer is intended for fitness and training purposes only. The App is not a medical device and does not provide medical advice. Heart rate data displayed may not be fully accurate. Always consult a healthcare professional before starting any exercise program. We are not liable for any health-related outcomes resulting from your use of the App.

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the property of PulsePacer and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from the App without our prior written consent.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, PulsePacer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising out of your use of the App.

9. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App is revoked.

10. Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we handle your information.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted here with an updated effective date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles.
